AFFILIATE PROGRAM AGREEMENT Last Updated: June 2, 2026
This Affiliate Program Agreement ("Agreement") is entered into between Rolene LLC, doing business as FindingYoYo ("FindingYoYo," "we," or "us"), and the individual or entity who accepts this Agreement ("Affiliate," "you"). By applying to and participating in the FindingYoYo Affiliate Program, you agree to the following terms.
1. Program Overview
FindingYoYo operates an affiliate program through which Affiliates earn commission by promoting FindingYoYo products to their audiences using a unique discount code or referral link provided by FindingYoYo.
2. Eligibility
To participate, you must:
- Be based in the continental United States (excluding Alaska and Hawaii)
- Maintain an active presence on Instagram and/or TikTok
- Be at least 18 years of age
- Have a valid US mailing address for gift shipments
3. Welcome Gift
Upon acceptance into the program, FindingYoYo will send you one complimentary jewelry piece ("Welcome Gift"). The Welcome Gift:
- Is provided at FindingYoYo's sole discretion
- Must be featured in your required content (see Section 5)
- Is non-exchangeable and non-refundable
- Can only be shipped to addresses within the continental US
4. Commission
- You will earn 10% commission on all qualifying purchases made using your unique affiliate code
- Commissions are paid monthly on the 20th of each month via gift card
- Minimum payout threshold: $20
- Commissions are forfeited on returned, refunded, or fraudulent orders
- FindingYoYo reserves the right to withhold commission if fraudulent activity is suspected
5. Content Requirements
Within 3 weeks of receiving your Welcome Gift, you must publish at least one permanent video reel on Instagram and/or TikTok featuring the jewelry. The video must remain posted for a minimum of 6 months and must include:
- A close-up shot of the jewelry (minimum 10 seconds)
- Mention of the brand name and material/design concept
- Tag of @findingyoyo (Instagram) or @findingyoyojewelry (TikTok)
- Your unique affiliate discount code
- Required hashtags: #FindingYoYo #pearljewelry #jadejewelry #FindingYoYoAmbassador #ArtisanalJewelry #demifinejewelry
- FTC-required disclosure: #ad or #gifted
Photo posts are optional but appreciated.
6. Bonus Incentive
For each qualifying video that exceeds 10,000 views, you will receive an additional $20 gift card (up to 5 videos per product). To qualify:
- Jewelry must be visible for at least 10 seconds with a close-up shot
- Brand name and material/design concept must be verbally or visually mentioned
- Views must be organic (no paid promotion on behalf of Affiliate)
- Bonus is paid together with monthly commission on the 20th
7. Content Submission
All photos and videos created featuring FindingYoYo products must be submitted to FindingYoYo within 7 days of posting. Submission process:
- Affiliate must upload all original photo and video files (in full resolution) to the Google Drive link provided by FindingYoYo upon acceptance
- Submitted files must be the original, uncompressed versions (not screenshots or downloaded social media files)
- FindingYoYo will provide a dedicated Google Drive folder link to each Affiliate upon acceptance
- Failure to submit content within 7 days of posting may result in forfeiture of the current month's commission and/or bonus
8. Gift Non-Compliance & Return Policy
The Welcome Gift is provided in good faith in exchange for Affiliate's fulfillment of content obligations. If Affiliate fails to publish the required content within 3 weeks of receiving the Welcome Gift:
- FindingYoYo reserves the right to request the return of the Welcome Gift at Affiliate's expense
- If the Welcome Gift is not returned within 14 days of such request, FindingYoYo may invoice Affiliate for the retail value of the gifted item
- Affiliate acknowledges that acceptance of the Welcome Gift constitutes agreement to fulfill all content requirements outlined in Section 5
- Commission will not be activated until required content has been published and submitted per Section 7
9. FTC Disclosure Compliance
All content featuring FindingYoYo products must clearly disclose the gifted/affiliate relationship in accordance with FTC guidelines. Required disclosures include #ad, #gifted, or #sponsored. Failure to comply may result in immediate termination of the Agreement.
10. Intellectual Property
- All content created by Affiliate remains the property of Affiliate
- By participating in this program, Affiliate grants FindingYoYo a non-exclusive, royalty-free license to repost, share, and use your content for marketing purposes across FindingYoYo's social media channels and website, with credit given where possible
- Affiliate may not use FindingYoYo's name, logo, or trademarks in any way that could cause confusion or damage to the brand
11. Independent Contractor
Affiliate is an independent contractor and not an employee, agent, or partner of FindingYoYo. Affiliate is solely responsible for any taxes arising from commission payments received.
12. Prohibited Conduct
Affiliate may not:
- Make false or misleading claims about FindingYoYo products
- Offer unauthorized discounts or promotions beyond the provided affiliate code
- Engage in self-referral or fraudulent transactions
- Promote FindingYoYo in a manner inconsistent with brand values or that could damage the brand's reputation
- Simultaneously promote direct competitor brands in the same content
13. Termination
Either party may terminate this Agreement at any time with written notice (email is acceptable). Upon termination:
- All pending commissions earned prior to termination will be paid on the next regular payment date
- Affiliate must cease using FindingYoYo's affiliate code, links, and branding
- Content already published does not need to be removed unless requested
14. Limitation of Liability
FindingYoYo's total liability to Affiliate under this Agreement shall not exceed the total commissions paid to Affiliate in the three months preceding the claim.
15. Governing Law
This Agreement shall be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
16. Modifications
FindingYoYo reserves the right to modify this Agreement at any time. Affiliates will be notified of material changes via email. Continued participation in the program constitutes acceptance of the updated terms.
17. Entire Agreement
This Agreement constitutes the entire agreement between the parties with respect to the Affiliate Program and supersedes all prior discussions and agreements.
By participating in the FindingYoYo Affiliate Program, you confirm that you have read, understood, and agree to this Agreement.
